By accessing or using Pixeliro ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 13 years of age, or the age of majority in your jurisdiction.

Pixeliro provides color palette generation, color analysis, and design tools for designers, developers, and creative professionals. Our services include:

• Color palette generation and management
• Color harmony and contrast analysis
• Color format conversion (HEX, RGB, HSL, OKLCH, etc.)
• Accessibility compliance checking (WCAG)
• Template previews for brand and product applications
• Export functionality for various design tools

Some features of our Service may require you to create an account. When you create an account, you must:

• Provide accurate and complete information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

We reserve the right to terminate accounts that violate these Terms or remain inactive for extended periods.

Your Content

You retain ownership of all palettes, color schemes, and designs you create using our Service. You grant us a limited license to display, store, and process your content solely to provide the Service.

Our Content

The Service and its original content (excluding user-generated content), features, and functionality are owned by Pixeliro and are protected by international copyright, trademark, and other intellectual property laws.

License to Use

We grant you a limited, non-exclusive, non-transferable license to use the Service for personal and commercial purposes, subject to these Terms.

You agree to use the Service only for lawful purposes. You must not:

• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Transmit harmful code, malware, or viruses
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use the Service for spam or unsolicited communications
• Scrape or harvest data without permission
• Resell or redistribute the Service without authorization

The following uses are strictly prohibited:

Pixeliro offers a Pro subscription plan with the following pricing:

• You agree to pay all fees associated with your chosen subscription plan
• Fees are billed in advance on a recurring basis (monthly or yearly depending on your plan)
• You authorize us to charge your payment method through our payment processor, Paddle
• Refunds are available as described in our Refund Policy below
• We may change our pricing with at least 30 days' notice to existing subscribers
• You may cancel your subscription at any time. Your access continues until the end of the current billing period

Refund Policy

We want you to be satisfied with our service. If you are not happy with your purchase, you can request a full refund within 14 days of payment — no questions asked.

• You are entitled to a full refund within 14 days of any subscription payment
• No conditions or justifications are required to request a refund within this period
• To request a refund, contact us at [email protected] with your account email, or reach out to Paddle (our payment provider) directly. Refund requests are typically processed within 5-10 business days
• After the 14-day refund window, you may still cancel your subscription at any time. Your access will continue until the end of the current billing period

Free tier users may access basic features without payment. Pricing is in USD and may be subject to applicable taxes.

We do not warrant that:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• The Service is free of viruses or harmful components
• The results from using the Service will meet your requirements

To the maximum extent permitted by law, Pixeliro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits or revenue
• Loss of data or content
• Loss of business opportunities
• Personal injury or property damage

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Pixeliro and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your content or materials

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including:

• Breach of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• At our sole discretion

Upon termination, your right to use the Service will cease immediately. Provisions that by their nature should survive termination shall survive.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Pixeliro operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by:

• Posting the updated Terms on this page
• Updating the "Last updated" date
• Sending an email to registered users
• Displaying a notice in the Service

Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
